You are referring to Ben Carey who was a member of Corsa SC and owned a 65 Turbo Corsa. Although the car shown in the Copart auction doesn't appear to be a Corsa, it was my understanding that his son was involved in a wreck and totalled the car sometime after Ben passed away. Dean F. I didn't dig too deep but I think you might have to be a Copart member to see the final results of completed auctions. The bidding was over $2700 when I posted the link about 5 hours before the auction closed and I don't recall seeing a reserve at that time. Nope, it's not mandated in any state law. You ALWAYS have the option of keeping the car, regardless of what the settlement agent says. When a drunk crossed both lanes of traffic and hit our parked '66 Mustang head-on, I told the insurance that I wanted to keep the car. He first told me I couldn't, but when I insisted that I wouldn't settle, without keeping the car, he quickly changed his tune. That Corvair looks saveable, unless the body is totally wracked. Having been in the collision repair business, I've had this discussion with customers many time. It is the OWNER'S car and they can do what ever they wish to it, choosing to have it repaired, choosing where to have it repaired, etc. Where the rush to do it wrong comes in is the rental car, when the insurance company threatens to pull the rental car, people cave. No need for rental, no rush to decide. Back in the day I also did a lot of keeping the "total" on the road, not perfect repair back to showroom condition, but keeping the person in a car to get to work/play/etc. without a new payment book. Just have the owner never give up the title to the insurance company. New title laws I'm not sure of. But no where should the picture of the damage to that Corvair exceed 75% of its value! Some guy backed into the front end, caving in the grill and puncturing the radiator. The insurance company wanted to total it. They offered $100 settlement and he kept the car. With the $100 he got a new radiator, threw away the grill, and continued to drive it. So extent of damage is irrelevant. It's all by percent of market value, as Frank points out. I can't see how they had the authority to do that (intent to sell a car they didn't own) and then apparently back out of a completed auction transaction (again a questionable action) unless they had a ridiculous reserve with the intended to never sell in the first place (yet again a questionable act). I understand WHY they would do that but find the method lacking ethic. I'm not contesting what the insurance company told you, it just seems their actions were very questionable in the way they went about giving you what you wanted. Glad it all worked out favorably for you in the end. I hear a lot of CoPart horror stories. Maybe these types of practices are part of the reason why.
